Re: State of Missouri ex rel. Martin F. Lindstedt, Relator
v. Newton County Clerk Kay Baum, et al.
Case No. 21279-1
Dear Mr. Lindstedt:
Today the Court issued the following Order:
"Now on this day, the Court takes up for
consideration the 'Petition for Writ of Mandamus and
Judicial Review of Election Laws,' and the Court,
having seen and examined said Petition, and having been
advised in the premises, does deny said application."
Yours very truly,
-s-
SANDRA L. SKINNER, Clerk

cc: Kay Baum, Newton County Clerk
Rebecca Cook, Missouri Secretary of State
.

Comments: As I suspected, the Missouri Court of Appeals, Southern District, slimed me by giving me a mere denial of petition for mandamus. Never addressed was the petition for judicial review of election law, which would have required a more thorough written opinion. If judicial review would have been properly and legally done and the election laws ruled unconstitutional, the mandamus would have followed by default. It would have had to, since there would be no valid legal reason to keep me off the ballot. So the Missouri Court of Appeals took the easy way out by denying my mandamus.
I followed this judicial sliming with a Demand for this Court’s Finds of Fact and Conclusions of Law Justifying Court Decision in Above Case to the Missouri Court of Appeals, Southern District. I did not expect or receive a response, and certainly didn't make any new friends, but it doesn't hurt to let them legalweasels on the court know you are on to them and their preserving the status quo for the politicians.
